Advent Calendar Sweepstakes Participation Conditions  

1. Subject 

1. These participation conditions govern participation in the “GARDENA Advent Calendar” sweepstakes (hereinafter “Advent Calendar Sweepstakes“) by GARDENA , Husqvarna UK, Preston Road, Newton Aycliffe, DL56UP (hereinafter “GARDENA“) and the processing of the data collected from or shared by the participants. 

2. By participating in the Advent Calendar Sweepstakes, the participants declare that they agree to the following participation conditions. 
    

2. Participation Conditions of the Advent Calendar Sweepstakes 

1. The Advent Calendar Sweepstakes begin on 01/12/2024 and end on 13/12/2024. 

2. Residents of the UK who are over 18 years of age are eligible to participate. Employees of GARDENA and employees of cooperation partners who are or have been active in the creation or process of the Advent Calendar Sweepstakes are excluded. 

3. Participation takes place exclusively at www.gardena.com/en/promotions/advent-calendar

4. Qualification to participate in the Advent Calendar Sweepstakes is obtained by visiting the web page www.gardena.com/en/promotions/advent-calendar, answering an initial question and then entering the personal data required for contact via the input screen (participation form). 

5. The purchase of GARDENA products is not a prerequisite for participation in the Advent Calendar Sweepstakes. 

3. Prize 

Daily changing prizes are drawn among all of the participants. The prizes consist of GARDENA products and additional products and services in the garden sector. A complete listing of the products to be won can be found in Table 1. 

4. Process 

1. The respective winners are selected from the pool of people that have qualified for participation by means of a draw. 

2. If a winner opts to waive the prize, another party is selected to be the winner by means of a draw. 

3. The winners are notified about the prizes they have won immediately upon their selection via email sent to the email address provided in accordance with Section 4.1. The winners are asked to respond within a deadline of 5 working days and to provide their address, which must be in the UK, for the purpose of shipping the prize.  

If a winner does not confirm their acceptance of their prize within a deadline of 5 working days following receipt of the prize notification by email, another participant is selected as a winner by means of a draw. 

4. The prizes are shipped by mail or package service to the shipping address disclosed by the winner. 

5. Each prize is personal and will be transferred by GARDENA only to the person whose personal data corresponds to that specified in the participation form in accordance with Section 2.3. A transfer of the prize by GARDENA to another person is precluded. 

6. Payment for the prize in cash or an exchange for another material asset is precluded. 

7. If the specified contact data of the participants is incorrect (for example, invalid email addresses), GARDENA is not obliged to determine the correct contact data. Penalties resulting from the entry of incorrect contact data are at the expense of the participants. 

5. Exclusion from Participation 

1. If a participant violates the participation conditions, makes use of unauthorized resources or otherwise gives themselves an advantage via tampering or attempts to do so, GARDENA maintains the right to exclude this participant from the Advent Calendar Sweepstakes. In this case, other claims against GARDENA are precluded. 

2. GARDENA also reserves the right to exclude participants who provide incorrect personal information. 

3. GARDENA also expressly reserves the right to any claims for damage caused by a participant having violated the participation conditions. 

6. Exclusion of Guarantee, Premature Termination of Sweepstakes 

1. GARDENA does not guarantee permanent and constant availability/accessibility to and operation of the Advent Calendar Sweepstakes. 

2. GARDENA reserves the right to terminate or end the Advent Calendar Sweepstakes at any time without advance notice and without claims toward GARDENA from the participants. This applies particularly in the event that, for legal or technical reasons (for example tampering, hacker attacks or errors in the hardware and/or software, etc.) or as the result of technical problems, changes in regulations or decisions made by hosting platforms such as Facebook, proper implementation of the Advent Calendar Sweepstakes is no longer possible. In the event of tampering, the Advent Calendar Sweepstakes can be declared invalid overall if it cannot be ruled out that it may have an influence on the result or the winning odds. 

7. General Liability 

1. In the event of intent and gross negligence, regardless of the legal reason, GARDENA is liable in accordance with legal regulations. 

2. In the case of negligence, GARDENA is liable only for damages caused by the violation of an essential contractual obligation, i.e. only when an obligation is violated whose fulfillment makes it possible to enforce the contract correctly and on whose compliance the participants may regularly be reliant. In this case, however, the liability is limited to foreseeable damages that are typical of the contract. 

3. The personal liability of the legal representatives and agents of GARDENA for damages that they have caused due to ordinary negligence is likewise limited to the extent described by Section 7 (2). 

4. The liability of GARDENA in the event of the fraudulent concealment of a deficiency caused by the assumption of a quality guarantee or a procurement risk in accordance with product liability law remains unaffected. Moreover, the liability limitations in Sections 7 (2) and 7 (3) do not apply to damages to life, body or health. 

8. Liability Limitations for Data Losses 

GARDENA is not liable for data losses due to technical reasons in the context of data transfer following successful entry at www.gardena.com/en/promotions/advent-calendar has taken place, insofar as the data loss is not caused by gross negligence or willful breach of duty on the part of GARDENA by a legal representative or agent of GARDENA.  

9. Privacy Notice 

1. We wish to provide information on the handling of personal data specified in the framework of the Advent Calendar Sweepstakes in accordance with Art. 13 of the General Data Protection Regulation (GDPR). The responsible party is GARDENA Husqvarna UK, Preston Road, Newton Aycliffe, DL5 6UP. 

2. The legal basis for the processing of your personal data is in accordance with Art. 6 Para. 1(b) of the GDPR (performance of a contract). The purpose of data processing is exclusively for the implementation of the Advent Calendar Sweepstakes. To determine and notify the winner, we process only their email address, the declaration that you are over 18 years of age as well as the data that you have provided voluntarily (address, first name and surname). In the event of a win, we also collect first names and surnames (unless previously provided voluntarily) and a postal address, which are required for sending the prize. Further details and supplementary terms for the implementation of the sweepstakes can be found in the section “(S) Sweepstakes” in our Privacy Notice. 

3. Access to the data is granted only to employees at GARDENA UK who require the data for the completion of tasks. Furthermore, the data is forwarded to third parties only to the extent necessary for processing in the event of a win or that is prescribed by law. 

4. Your data is stored until the Advent Calendar Sweepstakes has been executed in its entirety and then deleted, provided that this will cause no breaches in the legal requirements to retain data. 

5. If you have also subscribed to our newsletter, we will also use the email address provided to send a confirmation email of the newsletter subscription. The legal basis for this processing can be found in Art. 6, Para. 1(a) GDPR (consent). Details and additional terms with regard to our newsletter can be found in the confirmation email as well as in the section “(R) Direct Marketing” in our Privacy Notice. The decision to subscribe to the newsletter has no effect on participation in the Advent Calendar Sweepstakes.

10. Facebook Terms and Conditions 

1. In addition to these participation conditions, the relationship between GARDENA, the participant and Facebook is governed by the terms of service https://www.facebook.com/terms.php and data policy of Facebook, cf. https://www.facebook.com/policy.php. These apply in addition to the preceding conditions. In the event of any contradictions, the local participation conditions have priority. 

2. The sole organizer and responsible party for the Advent Calendar Sweepstakes is GARDENA. Facebook is not an organizer of the Advent Calendar Sweepstakes and only offers a platform for hosting. The Advent Calendar Sweepstakes is in no way sponsored, supported or organized by Facebook and retains no other connection to Facebook. Therefore, with respect to Facebook, participants shall not be entitled to any claims in relation to participation in the Advent Calendar Sweepstakes.  

3. All information and data shared by or collected from participants during the Advent Calendar Sweepstakes are provided only to GARDENA and not to Facebook. 

4. All inquiries and information with regard to the Advent Calendar Sweepstakes are to be directed to GARDENA and not to Facebook. 

5. Information about the privacy configuration between GARDENA and Facebook can be found in the section “(V) Social Networks and Other Platforms of Third-Party Providers” of our Privacy Notice. 

11. Other 

The decision of the organizers is final. 

12. Safeguarding Clause 

Should individual terms within these participation conditions be entirely or partially ineffective, this does not affect the effectiveness of the other regulations of these participation conditions.
